In the event that you have a dispute with one or more users of the “Platform”, you release “PBAG” (and our directors, agents, contractors, affiliates, parents, subsidiaries, and employees from claims, demands and damages of every kind and nature arising (whether directly or indirectly) out of such dispute.

“PBAG” sends emails and notices regarding the status of your matters and your user account. Our emails and notices do not represent any guarantee or endorsement
of your transactions. You are responsible for completing all transactions in which you participate (including monitoring the status of and complying with all relevant legal and other obligations). We do not control, endorse, or approve the services provided by the users of the “Platform”. You acknowledge and release “PBAG” if you deal with underage persons or people acting under false pretence.

Warranty

You agree to accept the sole responsibility for the legality of your actions used the laws which apply to you. You agree that “PBAG” have no responsibility for the legality of the actions of users or services of the “Platform”.

Indemnity

You indemnify and release “PBAG” and its directors, employees, agents, contractors, affiliates from and against any claims, demands, proceedings, losses and damages of every kind and nature including reasonable solicitor’s fees, made by you or any third party due to or arising (whether directly or indirectly) out of your breach of these
Terms and Conditions or your  violation of and law or the rights of a third party.

No Agency

You and “PBAG” are independent contractors and no agency, partnership, joint venture, employee-employer or franchisee-franchisor relationship is created or intended by this Terms and Conditions agreement or your use of “Platform” or “PBAG” services.

Third Party Links & Advertising

“PBAG” may display advertisements, which may or may not contain hyperlinks or buttons which take you to website, blog and various social media channels operated by third parties. “PBAG” does not endorse or recommend its advertisers, their products or services, or the information, products or services of any website, blog and various social media channels linked to the website, blog, and various social media channels.

If you contact a third party through the “Platform”, including via email, “PBAG” accepts no responsibility for any actions taken by that third party in connection with you as the user.

Disclosure

We do not charge “Consumers” of our “Platform”, to use our service. Instead you acknowledge that we may receive service fee, marketing fee, introducer fee, advertisement fee, lead generation fee, finder fee or other various type of fee, from the service providers, when one of our “Consumers” connects with them through our “Platform” and use the
service. You acknowledge that “PBAG” or its director(s) may act as conjunction agents or sub agents on a property purchase. “PBAG” may also earn a fee when users of our content platforms access a third-party provider or comparison website, blog, and various social media channels through our platform. The fee, as mentioned above, is a pay-on-success model, this means the service provider only pays if they are successful in providing the service. For the avoidance of doubt, you have no liability toward us regarding any payments owed to us by the service providers. It is also acknowledged that the cost to you charged by the service provider, does not increase due to the above-mentioned fees. Therefore, it will cost you the same whether you go directly or through this platform to the service provider and utilise their services. Also, you are not obligated to go through this platform and are free to use any other similar platform or other such companies in finding a service provider. This fee is important in running this platform, pay the various associated expenses and to keep investing in growing the network. The use of the platform remains free to you as “Consumer”.

Newsletters, offers and notification

You may use the “Platform” to subscribe to:

1. “PBAG” mailing list, in which case we will send you
2. our e-mail newsletter that provides details of new developments in the “Platform”, advertisements and other information that may be of interest to “Consumer” and
3. e-mail offers regarding our products and services (and the products and services of our trusted partners) that we think you may be interested in; and
4. service notifications (such as new property alerts or Buyer activity alerts), which may be sent to you by e-mail or SMS.
5. You may choose to stop receiving newsletters, offers and/or notifications at any time by using the ‘Unsubscribe’ details that appear in the newsletters, offers or notifications.
6. You can also manage your subscriptions to newsletters, offers and notifications by sending us an email at info@propertybuyersaustralia.com.au.
7. Our newsletter, offer and notification services are provided on an “as is” and “as available” basis, and to the extent permitted by law:

• we do not make any representation (or give any guarantee) as to the timeliness, correctness or availability of the newsletter or notification services; and
• we will not be responsible or liable for any costs or damages incurred by you not receiving newsletters, offers or notifications in any timeframe (or at all).
